Title III of the ADA is the title that applies to
private entities like hotels, stores, gas stations,
etc. If you own a public facilities such as schools,
city governments, fire stations etc. then go to the
Title II section.
Title III prohibits discrimination on the basis
of disability by public accommodations and in
commercial facilities. The Americans with
Disabilities Act is part of a series
of civil rights laws that date back to the 1960’s.
The unfunded mandates legislation that recently
passed in congress specifically exempted all civil
rights laws, including the ADA, from the unfunded
mandates legislation. In fact, congress and the
president recently stated that enforcing the ADA is
now a top priority for federal regulators.
